USHIO VA WORKS TERMS AND SERVICES

 

By commissioning our services, you automatically agree to abide by these terms and conditions in their entirety. If you disagree with any part of these terms and conditions, you may not proceed with the commission.

*Please note that these terms and conditions are subject to change at any time, and all clients, both old and new, will be notified of any changes.*

 

GENERAL TERMS
​

  • We reserve the right to refuse any commission that makes us uncomfortable.

  • Commercial use of our artwork requires the purchase of a commercial license. You are permitted to use the illustrations exclusively for Profile Pictures, Social Media Posts (including Timelines, Banners, and Announcements), and Video Thumbnails. Any unauthorized selling of our artwork will be considered COPYRIGHT INFRINGEMENT. The pricing for commercial rights may vary, starting at $100.

  • Payment for a commission signifies your acknowledgment and acceptance of these Terms of Service.

  • Violation of these terms may result in commission cancellation or blacklisting.

  • Removal of our signature from the artwork is prohibited unless you have obtained a Commercial License.

  • Usage of our artwork in AI art-generating programs is strictly prohibited.

  • Commissions are processed on a first-come, first-served basis.

 

PAYMENT METHOD

  • PayPal is the sole accepted payment method.

  • For commissions under $100, full payment is required upfront.

  • Commissions exceeding $110 can be paid with 50% upfront and 50% upon sketch approval.

  • Upon mutual agreement, an invoice requesting payment will be sent.

 

REVISIONS
​

  • Portraits to Waist Up commissions include a maximum of 2 revisions, while Full-body commissions allow for a maximum of 4 revisions.

  • Revisions are limited to the sketching phase. Once we proceed to the final output, no further changes will be accepted. Exceptionally, revisions to the final output may be considered if they result from a misunderstanding or miscommunication on our part.

 

PROCESS AND DELIVERY
​

  • Prior to initiating the commission process, please complete the order form. Subsequently, we will contact you through your chosen platform.

  • After agreeing to the terms, we will allocate a booking slot and commence the commission on the scheduled date.

  • The timeframe for completing your commission varies from 1 to 4 weeks, contingent on the artwork's complexity.

  • Upon completion, we will provide you with the final, full-resolution illustration.

 

CANCELLATION AND REFUND POLICIES

  • You will receive a full refund for any unforeseen circumstances or reasons on our part.

  • If you cancel your order before the Sketching Phase, you will receive a full refund.

  • Once we have initiated work on your commission, NO REFUNDS WILL BE GRANTED.

 

COPYRIGHT AND USAGE
​

As the artist, I will:

  • NOT claim intellectual property rights to the commissioned artwork unless the client violates these Terms and Services.

  • Maintain all copyrights over the commissioned artwork.

  • NOT profit further from the commissioned artwork unless the client breaches any terms and services.

  • Reserve the right to display the commissioned artwork on any social media platforms, including our portfolio and publications, such as art books.

 

For the commissioner:

  • Proper credits are mandatory unless you have purchased a Commercial License.

  • Usage rights and ownership of the artwork are separate. To utilize the original artwork for reproduction purposes like printing or merchandising, you must purchase a Commercial License.

  • You are permitted to print the artwork for personal use.

  • You may upload the commissioned artwork to websites and social media channels.

  • Removing our signature from the artwork is considered COPYRIGHT INFRINGEMENT unless you have acquired the COMMERCIAL LICENSE.

  • Claiming our art as your own or altering it without our consent is also considered COPYRIGHT INFRINGEMENT.

  • These revisions should enhance the clarity and accuracy of your terms and services document.
